Malaysia's Rules & Regulations for Hiring Foreign Workers

Malaysian laws and policies governing the employment of
foreign labour:
Malaysian
industries where foreign workers are permitted to work |
Cannot work
in any other industry besides manufacturing, construction, agriculture,
plantations, and services (cooks, cleaning, island resort, hotel, golf caddy,
cargo handling). |
Age |
Aged between
18 and 45 at the time of application. |
Certification |
1. The
applicant's nation must grant PASS Immigration and Security Clearance (ISC)
certification; and 2. The
candidate must receive a fitness and health certificate from recognised
medical facilities in their country. |
Those who are
not allowed to enter this country |
1. Unable to
demonstrate that he can support himself and his family, that he has a stable
job, or that he is not likely to fall into poverty. 2. Suffering
from a mental illness or an infectious or communicable sickness 3. Refuse to
consent to a medical exam. 4. Have been
found guilty of a crime or are associated with one. 5.
Prostitutes or those who live off the earnings of prostitution 6. Attempt to
bring in people for prostitution or other immoral purposes from outside
Malaysia. 7. Wandering
or persistent beggars. 8. Entry into
Malaysia is prohibited by all written laws. 9. Promotes
violence, undermines the government and its elected officials, or instructs
and promotes property destruction. 10. Anyone
associated with or a member of a group that supports the aforementioned
values or beliefs. 11. The
Minister deems them to be undesirable. 12. The
Director-General deemed the persons to be undesirable since their country had
repatriated them. 13. Do not
have or are not in possession of proper travel documentation; 14. Family
members and dependents of those who are forbidden from travelling. 15. The
Director-General has revoked the pass or permit. |

Countries
whose citizens may work in Malaysia |
1.
Bangladesh, India, Indonesia, Pakistan, Sri Lanka, Turkmenistan, Uzbekistan,
and Kazakhstan. Thailand, Cambodia, Nepal, Myanmar, Laos, Vietnam, and the
Philippines. 2. In
Malaysia, only men from the Philippines are permitted to work. 3. Apart from
manufacturing, all sectors are open to hiring Indian workers. 4. Male
Indonesian employees are accepted in all industries, except for
manufacturing. |
Malaysian recruiting practises for international workers:
Before arriving:
1.
Obtain a
foreign worker quota through the One Stop Centre (OSC) of the Ministry
of Home Affairs.
2.
Obtain the applicant's country's ISC results and
look up each applicant's results.
3.
Apply for a Visa with Reference (VDR) approval
at the immigration desk or online with the immigration department.
Post-arrival:
1.
Foreign employees may enter Malaysia through
legitimate entry points with a VDR granted by the immigration office and an
entry visa issued by the Malaysian Attaches Office in their home nation.
2.
After arrival, the employer has 24 hours to
finish the foreign worker's clearance procedure.
3.
Submit a Visit Pass (Temporary Employment)
[VP(TE)] application. Only after the person has a medical
certificate (FOMEMA) from a clinic or hospital that has been approved will
they be awarded a VP(TE). As soon as you enter Malaysia, you have 30 days to
complete it. Failure to do so will prevent the person from remaining in
Malaysia and finding employment.
